Differences Between Direct Appeals and Post-Conviction Relief

Direct appeals focus on legal errors evident in the trial record. Post-conviction proceedings, however, address claims that go beyond the trial record. These may include:

  • Ineffective assistance of counsel
  • Newly discovered evidence
  • Undisclosed exculpatory material
  • Unconstitutional sentencing factors

Even if an appellate court has affirmed your conviction, a post-conviction claim might still be viable. Success depends on presenting admissible, outcome-changing proof and skillfully navigating procedural rules. A thorough review of your trial file, appellate briefs, and any new evidence will help determine a potential path forward.

Important Considerations: Courts expect diligence. Unexplained delays can significantly undermine the credibility of your claim.
