What relief can I get through post-conviction?

The type of relief available depends on the specific violation and the court involved. Common outcomes include:

  • Vacatur: Counts may be vacated if there is insufficient or unlawful proof.
  • New Trial: A new trial can be granted for fundamental errors that occurred during the original trial.
  • Resentencing: This may occur due to mistakes in sentencing guidelines or statutes, or in light of new mitigating circumstances.
  • Collateral Relief: Targeted relief, such as removal from a registry or restoration of rights, can be pursued when authorized by law.

Courts customize remedies to address the specific harm; not every error warrants a new trial, nor does every claim justify immediate release. The goal is to provide relief that realistically and materially alters your legal standing, based firmly in the law.
