FROM THE LIBRARY:

What if I lose my appeal—are there other options?

Posted in

If your direct appeal concludes, several avenues may still be open. You might pursue a rehearing or discretionary review by a higher court, though strict deadlines apply.

Beyond direct review, post-conviction remedies offer further options. These include a Motion for Appropriate Relief in state court or a § 2255 motion in federal court. These motions allow for the introduction of claims not present in the original record, such as ineffective assistance of counsel or newly discovered evidence.

In specific situations, other targeted relief may be available, such as expungements, removal from a registry, or restoration of civil rights.

An experienced appellate lawyer can thoroughly assess your remaining options, evaluate the available evidence, and provide strategic advice on whether further litigation is both legally sound and advisable.
